Terms of Service

These Terms of Service (“Terms”) govern your access to and use of directorydpa.com and any related services (collectively, the “Site”) operated by DirectoryDPA(“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Educational Purpose Only — Not Financial, Legal, or Tax Advice

The Site provides general information about down payment assistance programs and related homebuying topics. The content is for educational and informational purposes only. It is not, and should not be relied upon as, financial advice, legal advice, tax advice, mortgage advice, real estate advice, or any other professional advice. You should consult a qualified lender, real estate agent, attorney, tax professional, or financial advisor licensed in your jurisdiction before making any decision based on information found on the Site.

2. No Guarantee of Accuracy or Availability

Down payment assistance programs change frequently. Eligibility requirements, income limits, purchase-price caps, funding levels, application processes, and even program existence can change without notice. While we make reasonable efforts to keep listings accurate and to record the date each program was last verified, we do not warrant or guarantee that any information on the Site is current, complete, accurate, or applicable to your situation. You must verify all program details directly with the administering agency or organization before relying on them.

3. No Agency, Brokerage, or Lender Relationship Through the Site

Use of the Site does not create a real estate brokerage relationship, agency relationship, lender-borrower relationship, attorney-client relationship, or any fiduciary relationship between you and DirectoryDPA or its operator. DirectoryDPAdoes not originate, broker, or service mortgage loans, and does not provide loans or grants of any kind. Although the Site’s editor is a licensed real estate agent in North Carolina, publication of content on the Site does not constitute the practice of real estate brokerage or any other licensed activity in your jurisdiction.

4. Third-Party Links and Programs

The Site contains links to third-party websites and resources, including the websites of government agencies, housing finance authorities, nonprofits, lenders, and program administrators. We provide these links for convenience only. We do not control, endorse, or assume responsibility for any third-party content, products, services, terms, or privacy practices. Your use of any third-party site is at your own risk and subject to that site’s own terms.

5. Permitted Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Scrape, crawl, or otherwise systematically extract data from the Site without our prior written permission, except as expressly permitted by our robots.txt;
• Reverse engineer, decompile, or attempt to access non-public portions of the Site;
• Use any automated means to interfere with the Site’s normal operation, including denial-of-service attacks, excessive request rates, or content injection;
• Copy, reproduce, distribute, or create derivative works from the Site’s content for commercial purposes without our prior written permission;
• Misrepresent your identity or your relationship with DirectoryDPA; or
• Use the Site in any way that violates applicable federal, state, or local law.

6. Intellectual Property

All text, graphics, layouts, code, and other materials on the Site, other than third-party content displayed under license or attribution, are owned by DirectoryDPA or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. The DirectoryDPA name and logo are trademarks of DirectoryDPA. You are granted a limited, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. No other license or right is granted.

7. User Submissions and Feedback

If you submit suggestions, corrections, or other feedback to us by email or otherwise, you grant DirectoryDPA a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into the Site without compensation or attribution. You represent that you have the right to make any such submission.

8. Disclaimer of Warranties

The Site and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, DirectoryDPA disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, and reliability. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, in no event shall DirectoryDPA, its operator, owners, employees, contractors, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any and all claims arising out of or relating to the Site shall not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless DirectoryDPA, its operator, owners, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may modify these Terms at any time by posting the revised Terms on the Site and updating the “Last updated” date. Material changes will be highlighted. Your continued use of the Site after the effective date of any revised Terms constitutes your acceptance of those Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these Terms, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and DirectoryDPA concerning the Site and supersede all prior or contemporaneous communications.
